Reclaiming $4,200 in IRS Withholding — An Indian Investor's Story

Arjun M. · Stock Investor, India

Problem

Arjun invested in U.S. stocks and ETFs through Interactive Brokers. Without a U.S. tax ID, IB automatically withheld 30% on all dividend and interest payments — the default IRS backup withholding rate. Over two years, this added up to over $4,200 in excess tax.

Approach

We obtained Arjun's ITIN and helped him understand the W-8BEN filing process. With his ITIN, he updated his W-8BEN with Interactive Brokers to claim the India–U.S. treaty rate (15% on dividends). We also prepared a 1040-NR to claim a refund on prior years' over-withholding.

Outcomes

  • ITIN issued in 58 days
  • W-8BEN updated — dividend withholding cut from 30% to 15%
  • 1040-NR filed to recover $4,200+ in prior withholding
  • IRS refund received within 4 months of filing

If you hold U.S. stocks, ETFs, or bonds through a broker like Interactive Brokers, Charles Schwab, or Tastytrade, you're likely being over-taxed right now.

Without a U.S. tax identification number, your broker has no choice: IRS rules require them to withhold 30% of all dividends, interest, and certain other payments made to unidentified foreign persons. This is called backup withholding.

An ITIN unlocks two things. First, you can stop future over-withholding — once you have an ITIN, you submit a W-8BEN to your broker certifying your country of residence. Most countries have a tax treaty with the U.S. that reduces the withholding rate, often to 15% or lower. Second, you can recover past over-withholding — if you were taxed at 30% when your treaty rate should have been lower, you can file Form 1040-NR to claim a refund from the IRS.

Arjun had been investing for two years before he learned about the ITIN. His refund more than paid for the ITIN service — many times over.

If you've been investing in U.S. markets without an ITIN, your broker has almost certainly been withholding at 30%. The sooner you get your ITIN, the sooner you stop losing money to unnecessary withholding.
